Removal Defense
Generally referring to proceedings before an Immigration Judge (IJ) where a lawyer from the Department of Homeland Security (DHS) is present to conduct cross-examination. Each side will have an opportunity to give oral or written closing arguments. The Immigration Court is also known as the Executive Office for Immigration Review (EOIR).
Appeals (BIA/Circuit Courts)
If you do not win your case before the immigration court, your immigration lawyer will reserve appeal to a higher court, the Board of Immigration Appeals (BIA). You must specify what type of proceeding you wish to appeal before the BIA. If the BIA dismisses your appeal, you may petition for review by the circuit court with authority over your case.
